MySOS Terms of Service

Allm Co. Ltd (the "Company") provides its "MySOS" service (the "Service") to users in accordance with this "MySOS Terms of Service" (the "Terms").

Article 1  (Application of Terms of Service)

The Terms is applicable to all relationships with the Company with respect to the use of the Service (including use of the Service's app; the same definition shall apply below) You may not use the Service if you do not agree to the Terms.

Article 2  (Definitions)

In the Terms, the following terms shall have the meanings as defined in the items below.

  1. Terms of Service: An agreement based on the Terms under which provision of the Service is received from the Company.
  2. User of the Service: A person who agrees to the Terms and uses the Service.
  3. Person who can assist: A person who is nearby at the time and discovers a User of the Service whose illness has undergone a rapid change or a person has a sudden illness and who can perform basic life support activities (relief activities).
  4.   5. App use conditions: Conditions for use of the service app separately determined by the Company.

In the event the service user himself/herself is experiencing an emergency or discovers a sick/injured person, any request for assistance is predicated upon a request for emergency assistance 119 being made.   7. Group code: Means a code given to a citizens' group or fire department group, etc., in a prefecture or municipality with whom the Company has established an agreement in advance. Users of the Service may register with the group code, and once they have entered such group, they can get information only available to the group.
  8. Group code administrator: A person who primarily manages the functions of the previous item, having made a contract in advance with the Company. This person belongs to a municipality or public organization, etc., which can transmit information to users of the Service who belong to a certain group code.

Article 3 (Contents, etc. of this service)

  1. This service is to provide the functions listed in the following items, details of which shall be as specified on this service application. Depending on the type of compatible terminal, the version of this service application, the contract status of the service user, etc., there may be restrictions on available functions.

  2. We may upgrade the version of this service application. In this case, it may not be possible to use all or part of this service application etc until the user upgrades the service application on the terminal.   3. The available area of ​​this service is domestic. Although the service user may be able to use this service even in areas other than the usable area, we do not guarantee anything about the use of this service in the area, but due to the use of this service in the area We will not be held liable for any damages to service users.
  4. GPS location information may be the nearest base station information when using from a location that is not captured by satellites, such as indoors. Regarding the accuracy of location information, it depends on the service of the mobile phone service provider and the mobile phone model of the user. Even if you use this service from a cellular phone with GPS function, accuracy varies depending on the location and conditions at the time of positioning. Data service is used for displaying map, route, and location information. Such data service may be changed from time to time, it may not be available depending on the region. Therefore, maps, routes, and location information may not be available, or information may lack accuracy or lack accuracy. We do not guarantee anything about using this service due to such accuracy but we assume no responsibility even if damage to the service user is caused by using this service with such accuracy.
  5. With this application setting, the service user can use this application without unlocking even when the mobile phone terminal screen is locked. We do not assume any responsibility even if damage to the service user occurs in the case of operation of the terminal by a third party or loss or theft of the terminal by the service user.
  6. The AED installation location information (hereinafter referred to as "AED map") to be provided by this service is the information published on "Japan nationwide AED map" It is displayed after permission of the service right holder. We do not guarantee the use of this service by this information at all and we assume no responsibility even if the service user is damaged by using this service based on that information.
  7. Information on AED installation places and facility information provided by local governments and public organizations may be changed. If you are a municipality or a public organization that can provide information such as AED installation location and facility information, please contact us.

Article 4  (formation of agreement on terms of use)

  1. A person who wishes to use this service agrees with the contents of these Terms and agrees with the Terms of Service Presentation Screen (hereinafter referred to as "Agreement Screen") on this service application. At the time when the consent button is pushed, the service user considers that it agrees with the contents of this agreement, and a contract based on this agreement shall be established between the user and the Company and shall take effect.

Article 5 (Handling of GPS position information)

Article 6  (Intellectual Property Rights etc.)

Article 7  (Prohibited matter)

A service user shall not perform any act corresponding to the following items in using this service.

Article 10 (Interruption of provision etc.)

Article 13 (Cancellation of this Agreement made by Service Users)

Article 14 (Effective Period)

Article 15 (Non-Guarantee / Disclaimer)

  1. When we find that a defect is found in this service application and acknowledge that it is necessary to repair such defect, we will make efforts to repair such defect, but we do not guarantee its realization.

The Company does not guarantee that this service application, etc. can be used on all compatible terminals, but the available functions are restricted depending on the type of compatible terminal, presence or absence of version upgrade of this service application by the user, etc. There are cases.
  3. The Company shall not be liable for any inappropriateness of conformity to the specific purpose of use, completeness of use results, usability, precision, reliability, safety, immediacy, third-party's rights, etc. It does not guarantee anything about.
  4. The Company may refer to the GPS location information function of this service application by referring to an external map search service, but the Company may display the GPS location information, the map information to be displayed, and installation location information of the AED to be displayed We do not guarantee the accuracy of this.
  5. The Company shall not be obliged to provide any technical service such as technical support, maintenance, function improvement, etc. on this service application to service users.
  6. Even if the service user suffered damage due to using this application or not using it, we will be liable for damages up to ten thousand yen, except in the case of intentional or gross negligence on the part of us.
  7. When the service user receives relief from the rescuer using this service application, it recognizes that it is due to acts of goodwill, and as a result, the service user, patient, injured / Even if either or both of the expected results can not be obtained, we will not make any objections, nor will we make any claims to our company, other service users or relievers.

Article 16 (Exclusion of Antisocial Forces)

  2. The service user shall guarantee not to perform any acts corresponding to any one of the following items by himself or a third party.

    2. Unreasonable request acts beyond legal responsibility

    4. Acts of disseminating the rumor, damaging the credibility of our company by using spoofing or using power, or obstructing our work

Article 17 (Transfer of rights, etc.)

The user of the service may not transfer the property or all or part of the obligation owed to the Company to the Company based on the use contract and transfer it to a third party and succeed it or provide it as collateral. Article 18 (Competent jurisdiction)

In the event that a lawsuit is required in connection with a use contract between a service user and the Company, the Tokyo District Court shall be the first examiner's exclusive jurisdictional court.

Article 19 (Governing Law)

The establishment, effectiveness, interpretation and performance of the use contract are governed by Japanese law.
